SMSPilot helps you search for flights by text and hands you off to airlines and agencies to book. Here’s the deal.

01 Agreement

These Terms of Service (“Terms”) govern your use of SMSPilot — our text-message flight-search service, the website at smspilot.app, and the booking pages we host (together, the “Service”). By texting SMSPilot or using the Service, you agree to these Terms. If you don’t agree, don’t use the Service.

02 What SMSPilot does

SMSPilot is a search and referral tool. You tell us where and when you want to fly; we reply with flight options and links to third-party airlines and travel agencies where you can complete a booking. We are not an airline, travel agency, or seller of travel. We don’t process payments, issue tickets, or enter into any travel contract with you.

Your booking is with the airline or agency, not with us. Their terms, prices, fees, baggage rules, change and cancellation policies, and refunds all apply — read them before you pay.

03 Eligibility & your account

You must be at least 18 years old (or the age of majority where you live) and able to enter a binding contract to use the Service. You’re responsible for the mobile number you text from and for everything sent from it. Keep your device and number secure.

04 Messaging terms

By texting SMSPilot, you consent to receive automated and manually sent texts from us, including search results, follow-up questions, itineraries, service notices, and occasional relevant offers or surveys. Message and data rates may apply and frequency varies. Reply STOP to opt out at any time, or HELP for help. We may also limit, throttle, or pause messaging to protect the Service.

05 Acceptable use

When using SMSPilot, you agree not to:

  • Use the Service for anything unlawful, fraudulent, or harmful.
  • Send abusive, harassing, or deceptive content.
  • Scrape, spam, overload, probe, or disrupt the Service or its infrastructure.
  • Reverse-engineer, copy, or resell the Service, or use it to build a competing product.
  • Circumvent rate limits, access controls, beta gating, or any security measure.
  • Misrepresent who you are or use the Service on someone else’s behalf without their consent.

We may suspend, restrict, or terminate your access at any time, with or without notice, for any reason — including suspected violation of these Terms.

06 Prices, availability & accuracy

Flight data comes from third parties and changes constantly. Prices, seats, times, and availability we show are estimates that can change or expire before you book, and may differ from what you see at checkout. We don’t guarantee that any result is accurate, current, complete, available, or the lowest price. Always confirm the final price and details on the airline’s or agency’s site before paying.

07 Affiliate relationships

SMSPilot earns affiliate commissions when you book through some of the links we provide. This comes at no extra cost to you and helps keep the Service free. It doesn’t change the price you pay, and we aim to show you the best options we find regardless of commission.

08 Third-party services

The Service relies on and links to third parties — including airlines, travel agencies, and the service providers that help us operate. We don’t control them and aren’t responsible for their content, products, pricing, conduct, or policies. Your dealings with any third party are solely between you and them.

09 Intellectual property

SMSPilot, its name, logo, design, software, and content are owned by us or our licensors and protected by law. We grant you a limited, personal, non-transferable, revocable license to use the Service for your own flight searches. You get no other rights. Don’t use our branding without written permission.

10 Service provided “as is”

The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We don’t warrant that the Service will be uninterrupted, error-free, secure, or that any flight, price, or result will be available or correct. You use the Service at your own risk.

11 Limitation of liability

To the fullest extent permitted by law, SMSPilot and its operators won’t be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits, missed flights, travel disruption, or data loss, arising from or related to your use of the Service — even if we’ve been advised of the possibility. Our total liability for any claim relating to the Service is limited to the greater of (a) the amount you paid us for the Service (which is typically $0) or (b) US $50.

12 Indemnification

You agree to defend, indemnify, and hold harmless SMSPilot and its operators from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your bookings, or your violation of these Terms or any law or third-party right.

13 Changes to the Service & Terms

We may change, suspend, or discontinue any part of the Service at any time without notice. We may also update these Terms from time to time; when we do, we’ll update the “last updated” date above. Your continued use of the Service after a change means you accept the revised Terms.

14 Governing law & disputes

These Terms are governed by the laws of the United States and the state in which we operate, without regard to conflict-of-law rules. You agree that any dispute will be resolved on an individual basis — not as a class action — and you and we waive the right to a jury trial where permitted. If any part of these Terms is found unenforceable, the rest stays in effect.
